Refund. 7 When we were talking about the Ed. 8 Refund proposal that you have on the table, it was 9 what happens if we continue to bargain past the date 10 that you have without an extension of the contract. 11 And you said you would get back to us. So I just 12 wanted to see if you got a response to that. 13 MR. FREDRIKSEN: The proposal, as it 14 was written, was that the suspension is for the 15 period of time, until the end of the contract, and 16 the suspension could be continued if the contract 17 was extended. 18 So past that, the suspension does not 19 continue. 20 MS. We heard 7 what the Company was saying regarding the timeline 8 of the proposal that we had about the Savings Plan 9 Match. So taking into consideration -- while the 10 Company didn't commit to that, this is the only 11 issue. We heard what you were saying. We came up 12 with an alternative counterproposal, and I will read 13 the entire thing. 14 "Side Agreement - Company Match, March 15 30, 2021. 16 "This agreement is entered into by the 17 ILEU and ExxonMobil Research and Engineering, 18 hereinafter known as the Company, on the date the 19 agreement is reached. 20 "Number 1, the Company match is 21 suspended. 22 "Number 2, in the event that the 23 suspension of the Company match contribution is 24 lifted at any time for any U.S.-based employees 25 within ExxonMobil, the Company shall immediately Rita Gardner ~ Court Reporter ~ (908) 319-1195 6 1 reinstate the match for all Bargaining Unit 2 employees at that time. 3 "Number 3, on the date that the Company 4 reinstates the match, any employees within the 5 bargaining unit that were affected by the Match 6 suspension will, from this point forward, be 7 protected from any future suspension of the Savings 8 Plan Match until the date they retire, are promoted 9 or transferred out of Bargaining Unit, or are 10 otherwise separated from the Company. 11 "Number 4, any Savings Plan Match 12 increases that are applied to U.S.-based employees 13 of ExxonMobil will apply to these protected 14 individuals, but it may not be decreased for any 15 reason. 16 "The parties agree that this agreement 17 is entered into on a non-precedent-setting basis and 18 shall not be used in the future by the Company in 19 any attempt to modify its obligations under the 20 Savings Plan or any other negotiated or implied 21 benefit." 22 MS.
